Privacy Policy
COLLECTION OF INFORMATION
This privacy policy (“Policy”) describes how LifeSpot Technology, Inc., ("LifeSpot") collects and uses information provided by and about you when you download and register for use of the LifeSpot App.
Typically, the App will be provided to you in conjunction with another entity, such as an employer, landlord, building management company, educational institution, or another large user that provides a location or facility in which you may encounter an active threat (these large entities are referred to as “Enterprise Users” or "LifeSpot Administrator").
This Policy only governs the information collected about you by LifeSpot. Any information you provide to an Enterprise User will be governed by your relationship with that Enterprise User. In addition, any information provided by an Enterprise User to LifeSpot will be governed by our agreement with that Enterprise User. If you have questions about any such information, please consult your Enterprise User/LifeSpot Administrator.
The App is available for download by anyone from the Apple App Store and the Google Play store. Once you download the App, you can enter your registration code to activate the App. The code would be provided by your Enterprise User/LifeSpot administrator. Once you activate the App, we will be able to identify your device and any personally identifiable information that you provided to us during registration (collectively, “Personal Information”).
Among the Personal Information that we may have access to is the following:
Name
Device identifier
Phone number
Type of mobile device
The operating system of your mobile device
IP address
Wireless carrier
Email address
When you activate the App, we can automatically start to collect detailed real-time precise location information, which may be in the form of GPS signals from the mobile device on which you have installed and activated the App or Bluetooth location or wireless tracking using near field tracking technology (“Location Information”). We may use various technologies to determine your Location Information, such as location services of the applicable operating system or browser, GPS, Bluetooth, i-Beacon, RFID, and sensor data from your devices, along with nearby Wi-Fi access points and cell towers, and other technologies to determine your device’s location. This information would be used to send you the important messaging regarding your device (ex:. in/out of your assigned facility geo-fence).
After an activation from the App your Location Information would be shared on a map if your App was opened inside of your assigned geo-fence. For your safety, the App only shares your Location Information with emergency responders using the LifeSpot Commander version of the App. The App includes real-time communication features that allow you to communicate with emergency responders. In the event the App is activated, you should only use such communication features to share your Location Information with users of the LifeSpot Commander version of the App.
USE AND DISCLOSURE OF INFORMATION:
LifeSpot may use any non- Personal Information that it collects, such as the performance of the App, accuracy of Location Information, information about devices, etc. (“Usage Information”) to improve the App and to assist law enforcement/emergency responders. You agree that all information collected when the App was activated may be used by LifeSpot for this purpose and may be provided to
law enforcement/emergency responders in connection with any investigation.
LifeSpot may use Usage Information to facilitate the provision of software updates, product support and other services to you (if any), including by sending email or text messages to your wireless phone, tablet, or other mobile device (each a “Device”). You also grant LifeSpot an irrevocable, perpetual, royalty-free right and license to use your Usage Information to enhance our products and services and to develop new products and services. Your permission will be requested in writing before use.
LifeSpot may use your precise geographical location information in order to provide you with information about your performance and that otherwise provide services and functionality that you have requested. You also agree that LifeSpot may share any information you provide in the event of a sale, merger, dissolution, bankruptcy, corporate reformation or other corporate restructuring of LifeSpot, or in the event that LifeSpot sells, assigns, or transfers substantially all of its rights in the App.
LifeSpot may also disclose any your information with third parties as follows: (a) to the extent necessary to comply with applicable law and our legal obligations, such as to comply with a subpoena or similar legal process or assist law enforcement with an investigation into a legitimate threat event; (b) when LifeSpot believes in good faith that disclosure is necessary to protect its rights, your safety or the safety of others, including persons with whom you have arranged meetings via the App; (c) with third party vendors, consultants and other services providers who work for us and need access to your information to do that work; (d) to investigate fraud, or respond to a government request.
LifeSpot does not access any of the personal information or credit card information that you have provided to Apple or Google in order to register for their services. You should be familiar with the privacy practices of Apple and Google before providing such information.
SECURITY:
LifeSpot takes commercially reasonable steps to help protect your information against loss, misuse and unauthorized access, or disclosure. HOWEVER, LIFESPOT EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO ENSURING, GUARANTEEING OR OTHERWISE OFFERING ANY DEFINITIVE PROMISE OF SECURITY IN CONNECTION WITH YOUR INFORMATION.
